US customs duties and additional tariffs are among the critical risk and cost items for companies engaged in cross-border trade. A new judicial decision in the US as of February 20, 2026, and the subsequent statements are being closely followed, especially by exporting companies.

In this article, we have clearly summarized the current situation in US customs duties, which regulations are in force, and the current picture regarding products of Turkish origin.

Supreme Court Decision on US Customs Duties

On February 20, 2026, the US Supreme Court ruled to invalidate certain tariffs implemented under the IEEPA (International Emergency Economic Powers Act).

New Additional Tariff Under Section 122

Following the court decision, the US administration announced that under Section 122:

• An additional tariff of 10% would be applied globally.

• In a subsequent statement, Donald Trump indicated they increased this rate to 15%.

Important note:
The official technical guidance for this implementation has not yet been published by U.S. Customs and Border Protection (CBP). Therefore, the details of the implementation (scope, exemptions, calculation method) are not yet clear at this time.

Are Turkish Origin Products Affected?

In line with the current official announcements:

• There is currently no additional or different implementation for products of Turkish origin.

• No additional tariff changes have been announced for export processes originating from Turkey.

In other words, in today's picture, there is no operational change regarding shipments from Turkey to the US.

Which US Tariffs Remain in Force?

The following tariffs previously introduced by the US government remain in effect as they are:

• Section 232 tariffs

• Section 301 tariffs

• All other existing duties collected by the US government and paid to the US Treasury

In this context, the currently applied customs duties have not been canceled.

Refunds and Tax Processes

As of the current official status:

• No regulations regarding refunds have been announced

• No return process has been initiated for the taxes collected
